Geomo Terms of Service

§1. General provisions

  1. These Terms set out the rules for using the Geomo website available at geomo.app (the “Service”) and constitute the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services.
  2. The service provider is Maciej Duszak, running a business under the name Arabean — Maciej Duszak, address: ul. Chachaja 27/13, 52-405 Wrocław, Poland, Tax ID (NIP): 6912271890, REGON: 362895924, email: [email protected] (the “Provider”).
  3. A user is any person using the Service (the “User”). Using the Service requires accepting these Terms; starting to use the Service means accepting them.
  4. All services of the Service are free of charge.

§2. Services

The Provider offers the following electronic services:

  1. Bike geometry fit analysis — based on data entered by the User (e.g. height, inseam, mobility, preferred position), the Service estimates how well bike sizes from the database or entered manually fit, compares bikes, finds models with similar geometry (Geometry Twin) and suggests models meeting the chosen criteria (Bike Finder).
  2. User account (optional) — saving the profile, bikes and collections and syncing them between devices. Sign-in uses a link sent by email or a Google account.
  3. Contact form — sending a message to the Provider.

Without an account, the User's data is stored only in their browser.

§3. Technical requirements

  1. Using the Service requires a device with internet access and an up-to-date web browser with JavaScript and local storage (localStorage) enabled.
  2. Creating an account requires an active email address or a Google account.
  3. Using the internet involves typical risks (e.g. malware, interception of data sent over unsecured connections). The Service works only over an encrypted HTTPS connection.

§4. Conclusion and termination of the agreement

  1. The agreement for using the Service without an account is concluded when the User starts using the Service and terminates when they stop using it.
  2. The account agreement is concluded for an indefinite period at the first sign-in (clicking the link from the email or signing in with Google).
  3. The User may terminate the account agreement at any time without giving a reason by deleting the account in the app (“Delete account”) or by writing to [email protected].
  4. The Provider may terminate the account agreement with 14 days' notice for important reasons (e.g. the Service being discontinued), informing the User by email, or with immediate effect in the event of a gross breach of these Terms by the User.

§5. Nature of the results

  1. The results shown in the Service (e.g. fit percentage, size suggestions, warnings and recommendations) are for information only and are estimates. They are calculated from general geometric relationships and the data provided by the User.
  2. The Service is not medical or physiotherapy advice and does not replace a professional bike fitting performed in person by a specialist. In case of pain or injury, consult a doctor or physiotherapist.
  3. Bike geometry data comes from publicly available manufacturer materials. Despite our efforts, it may contain errors or be outdated. Before buying a bike, verify the data with the manufacturer or seller and — where possible — test ride the bike.

§6. User obligations

The User agrees to use the Service lawfully and in accordance with these Terms, and in particular:

  1. not to provide unlawful content (e.g. in the contact form, collection names or manually entered bike data);
  2. not to disrupt the Service, including attempts to bypass security measures, overloading the servers or automated downloading of the database content;
  3. to provide their own, genuine email address in the contact form and when creating an account.

§7. Liability

  1. The Provider makes every effort to keep the Service running continuously and correctly but does not guarantee constant availability. Technical breaks are possible and will be announced in the Service where possible.
  2. The Provider is not liable for purchase decisions or for the consequences of using a bike made solely on the basis of the Service's results, subject to section 3.
  3. These Terms do not exclude or limit the Provider's liability towards consumers to the extent that mandatory provisions of law do not allow it.

§8. Complaints

  1. Complaints about the Service can be sent to [email protected]. A complaint should include an email address for the reply and a description of the problem.
  2. The Provider handles a complaint within 14 days of receiving it and replies by email.
  3. Consumers may use out-of-court complaint and redress procedures, e.g. the help of a district (municipal) consumer ombudsman or the provincial Trade Inspection. Information is available at prawakonsumenta.uokik.gov.pl.

§9. Right of withdrawal

  1. A consumer may withdraw from the account agreement within 14 days of its conclusion without giving a reason, by sending a statement to [email protected] or by deleting the account in the app.
  2. The provisions concerning consumers also apply to a natural person concluding an agreement directly related to their business activity where the agreement is not of a professional nature for them (Article 38a of the Polish Consumer Rights Act).

§10. Intellectual property

The app, its design, the Geomo logo, texts and fit assessment algorithms are protected by copyright and belong to the Provider. Names and trademarks of bike manufacturers belong to their owners and are used only to identify models.

§11. Personal data

The processing of personal data and cookies is described in the Privacy Policy.

§12. Changes to the Terms

  1. The Provider may change these Terms for important reasons, in particular changes in the law or in the scope of services.
  2. The Provider announces changes in the Service and — to Users with an account — also by email, at least 14 days before they take effect. A User who does not accept the changes may delete their account before that date.

§13. Final provisions

  1. These Terms are governed by Polish law. This choice of law does not deprive consumers of the protection afforded to them by mandatory provisions of the law of their country of habitual residence.
  2. Disputes are resolved by the common courts having jurisdiction under the Polish Code of Civil Procedure.
  3. These Terms are available free of charge in the Service in a form that allows them to be downloaded, stored and printed.
